01 / Introduction & Contract Formation

MistyCurves operates as a boutique travel design studio based in Himachal Pradesh, India. All bookings made with MistyCurves are subject to these Terms & Conditions. A binding contract is established once we receive your booking deposit and issue a written confirmation invoice via email or WhatsApp.

02 / Bespoke Itineraries & Conceptual Blueprints

The tour packages displayed on our website (including itineraries for Himachal Pradesh, Kashmir, Ladakh, Uttarakhand, Rajasthan, Kerala, Goa, and Andaman) serve as indicative blueprints. Because every journey is tailored from scratch, your final confirmed itinerary—including specific hotel properties, vehicle types, and daily activity order—will be explicitly documented in your personalized travel contract.

03 / Booking Deposits, Pricing & Payment Schedule

• Quoted Pricing: All quotes are rendered in Indian Rupees (INR) unless otherwise specified. Prices include boutique accommodations, private vehicle transfers, breakfast, and specified local sightseeing as outlined in your confirmed voucher.
• Booking Deposit: A non-refundable initial deposit (typically 30% to 50% of the total journey value) is required at the time of confirmation to hold hotel reservations and private transport.
• Balance Payment: The remaining balance must be cleared prior to or on Day 1 of your journey upon arrival, as specified in your confirmation voucher.
• Payment Methods: We accept UPI, Net Banking, Credit/Debit cards, and direct bank transfers. All online transactions are encrypted via PCI-DSS compliant payment gateways.

04 / Cancellations, Refunds & Modifications

If you need to cancel or modify your confirmed trip, notice must be provided in writing tomistycurvesholidays@gmail.com or via your assigned travel designer. The following refund schedule applies:

• 30+ Days Prior to Departure: Deposit retained or converted into travel credit for future dates minus supplier non-refundable charges.
• 15–29 Days Prior to Departure: 50% of the total trip cost is forfeited.
• 0–14 Days Prior to Departure / No-Show: 100% of the total trip cost is non-refundable.
• Rescheduling: We make every effort to offer flexible date changes without penalty, subject to hotel availability and seasonal tariff adjustments.

05 / Force Majeure, Weather & Mountain Disruption

Travel through mountain terrain (Spiti Valley, Ladakh, Rohtang Pass, Kashmir) and coastal islands (Andaman, Kerala) involves unpredictable natural factors. MistyCurves cannot be held liable for delays, rerouting, or missed connections caused by:

• Extreme weather, heavy snowfall, landslides, or flood warnings
• Government road closures, VIP movements, or civil disturbances
• Flight or train cancellations/delays by third-party carriers

In any Force Majeure event, your 24/7 on-trip coordinator will immediately arrange safe alternative routing, emergency stays, or itinerary adjustments. Any additional expense incurred due to extra room nights or special transport shall be borne by the guest.

06 / Passports, Permits & Government Identification

Guests are responsible for possessing valid government-issued photo identification (Aadhaar Card, Voter ID, Passport, or Driving License for Indian nationals; valid Passport and Indian Visa for foreign nationals/NRIs). Inner Line Permits (ILP) required for restricted Himalayan zones (Spiti Valley, Nubra Valley, Pangong Lake) will be arranged by MistyCurves upon receipt of required ID copies.

07 / Health, Altitude Acclimatization & Insurance

• High Altitude Travel: Expeditions into Spiti Valley and Ladakh involve altitudes exceeding 10,000 feet. Guests with pre-existing heart, respiratory, or severe health conditions must consult a physician prior to booking.
• Acclimatization: Guests must follow recommended acclimatization rest days in Leh or Kaza as prescribed by our mountain guides.
• Travel Insurance: We strongly advise all travellers to obtain comprehensive travel, health, and baggage insurance covering high-altitude medical evacuation and flight cancellations.

08 / Personal Belongings & Vehicle Conduct

MistyCurves is not responsible for loss, theft, or damage to personal luggage, cameras, jewelry, or cash during vehicle transfers, hotel stays, or outdoor activities. Guests are expected to maintain courteous conduct towards drivers, local guides, and hotel staff. Smoking and consumption of alcohol inside private transport vehicles is strictly prohibited.

09 / Governing Law & Jurisdiction

These Terms and Conditions are governed by the laws of India. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the courts located in Himachal Pradesh, India.
